Subject: Carr Case-punishing uppity fathers Hello all, Some of you may not be aware that when Robert Carr first put in his notice of appeal of Judge Ginsburg denial of his parental rights, Ginsburg ordered him to pay $9400 toward his ex-wife's appeal rebuttal. A lawyer with the Civil Liberties Union managed to get the Appeals court to stay that order pending the end of the appeal. Well, Robert Carr created a stupendous appeal that delineated the right of a father to parent his child (not visit him!). He made the case in terms of federal law/citations and in terms of Mass. law/citations. The Mass Appeals Court in their decision showed that they have no intention of following 'the law' or any law that support a man's unalienable rights. They are a political group and have now shown themselves to be a disgrace to concept of justice. Yet, Robert's brief contains the necessary arguments in legal terms to influence a 'real court' -perhaps the federal courts -perhaps the Supreme Court. It is this brief, -the only one that I know of across this country- that makes the legal issue clear that fathers -equal in marriage by law, must be treated equally in divorce with equal parenting rights. However, we must realize that no court will act on important issues unless their is a sizable political faction pushing it. That's the way it is. But now Robert Carr is facing a contempt hearing on Ginsburg's order to pay $9400 for his ex-wife's appeal rebuttal -since the appeal is over and he (and we) have temporarily lost another battle. He has not the money and can't even afford a lawyer. (He did his appeal pretty much on his own research over 3 years.) This is just another way that the present legal system-geared against fathers- punishes fathers for objecting to the denial of their rights, children, their enslavement. His contempt hearing is scheduled on April 29, 1998. I think that we ought to make a public issue of this punishment (perhaps seasoned by a jail sentence, as is Ginsburg's forte') and perhaps a rally at the hearing. He's created the brief, that we can use to legally justify what we know to be our unalienable rights. Publicity will pyrrhicize the Political Appeals Court's vindictive judgment against Robert and Us.
